As of 12 August 2026, AI can only partly draft your NDA.
This still needs a person who signs their name to it.

Who has to check ita professional
What the alternative costsA solicitor commonly drafts or reviews an NDA for £200 to £500; the Intellectual Property Office publishes free model agreements.
If this goes wrong: the agreement fails exactly when you need it, in a dispute, where an unenforceable clause is discovered by the other side's lawyer rather than by you.
What to actually do
Hand it to a person
The route this page recommends
Someone with a licence or accountable authority has to sign this before it counts.
Where to find a person today
Law Society Find a Solicitor
The Law Society's official, free public search of solicitors in England and Wales, searchable by legal issue and location.
When the information you are protecting is worth an agreement, it is worth a solicitor who signs their advice; the Law Society's register is the official, free way to find one.
Use a tool built for this
Second choicePurpose-built software does the mechanical share of this.
IPO model NDAs
Free
The Intellectual Property Office publishes free one-way and mutual example NDAs: a genuinely free starting point written for English law, which is what a general model cannot promise.
Rocket Lawyer
A membership service at £34.99/month (Rocket Legal) with NDA templates, guided drafting and document review by legal professionals: the priced middle step between a free template and a solicitor's letterhead.
Do it yourself
The distant thirdA chat interface gets you a draft, but you cannot verify it yourself. That is the catch.
Prompt
Draft a short mutual non-disclosure agreement under English law for the situation I describe below, in plain English. After the draft, list every clause a solicitor should check before anyone signs, with one line each on what could make it fail. Then list the questions you would have asked me if you were the solicitor, so I can see what the draft is missing.
Open it prefilled in ChatGPT or Claude, or copy it into Gemini, which takes no prefill link.
What it gets wrong
- It mixes American boilerplate into English-law drafts: governing-law slips, US-style definitions and remedies that read fine and fit badly.
- It cannot tell you whether a clause is enforceable, and it presents the doubtful ones with the same confidence as the safe ones.
- It does not know what you are actually protecting, so the definition of confidential information, the clause the whole agreement hangs on, defaults to generic.
What caps this at PARTLY: legal accountability, verification cost and judgement under ambiguity.
How we scored this
Five axes, each scored nought to two by hand: ten means AI carries the task cleanly, and the thresholds that turn a total into YES, PARTLY or NO are published in the methodology. Each axis name links to its definition.
| Axis | Score (0–2) |
|---|---|
| Output | 1 |
| Inputs | 1 |
| Verification | 0 |
| Liability | 1 |
| Effort delta | 2 |
| Total | 5 / 10 |
The methodology and its thresholds are published in full.
FAQ
- Can ChatGPT draft an NDA?
- Partly. The answer here is PARTLY. It produces a plausible draft quickly, and a plausible draft is the danger: enforceability under English law is exactly what you cannot verify by reading it. Use the draft to get specific, then have a professional make it safe to sign.
- Are AI-written contracts legally binding?
- A contract does not care who typed it: signed agreements bind either way. The question is whether the clauses do what you think they do when tested. That is a judgement about enforceability, and it is the one part no chat can check for you.
- What can AI safely do for our NDA?
- Preparation. Have it explain clauses in plain English, list what a mutual NDA should cover for your situation, and draft the questions to bring to a solicitor. A meeting you arrive at prepared is shorter, and shorter is cheaper.
- Is there a free NDA template in the UK?
- Yes. The Intellectual Property Office publishes free example one-way and mutual NDAs written for English law. A solicitor commonly charges £200 to £500 to draft or review one properly, which buys the thing no template carries: someone accountable for whether it holds.
